The defendant is a driver of a motor device bicycle.

The driver of a vehicle shall pass along the roadway on the road that is divided into a sidewalk and a roadway.

Nevertheless, the defendant passed the bicycle on February 5, 2016 at the front of Songpa-gu Seoul Metropolitan Government D, Songpa-gu, Seoul around 16:17.
