그럼에도 불구하고, 피고인들은 2018. 9. 21.경부터 2018. 10. 12.경까지 위 게임장에서, 손님들이 현금을 투입하면 게임기 화면 하단 ‘CREDIT' 창에 1원당 1점의 점수가 생성되고 게임 1회당 250원씩, 시간당 120,000원까지 차감되면서 게임이 실행되어 일정 숫자나 비행기, 기차 등 특정 배경화면이 연출되면 그에 따라 골드카드가 획득되어 게임기 화면 ’골드카드‘ 창에 점수가 표시되는 ’우주열풍‘ 게임기 20대 등을 설치하고 불특정 다수의 손님들의 이용에 제공하면서 자동진행장치(속칭 ’똑딱이‘)를 이용하여 이용자의 능력과 무관하게 획득한 ’골드카드‘ 점수를 무기명 IC카드에 적립해 주어, 손님들이 자유롭게 위 IC카드를 서로 교환할 수 있게 하고 위 점수에 해당하는 금액만큼 다시 게임을 할 수 있게 함으로써 위 IC카드에 교환가치를 부여하고, 손님들이 위 게임장 안팎에서 위 IC카드를 다른 손님들에게 양도하는 등 현금화할 수 있도록 하였다.
