1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On April 2, 2013, B delegated the Plaintiff with a claim of KRW 281,90,000 for loans (including a claim for provisional attachment, compulsory execution, etc.) against the Defendant, a partner of the previous wife who was divorced from the Plaintiff on April 2, 2013, and agreed to pay the contingent fee by considering the entire amount of the claim as a winning fee in the case of a favorable judgment instead of paying the Plaintiff first, the stamp, service fee, appraisal fee, etc. necessary to handle the delegated affairs shall be paid by 25% of the winning amount (including interest and the amount of compensation) including the litigation cost when the Plaintiff first rendered a favorable judgment.
B. Under the above litigation delegation contract, the Plaintiff filed a lawsuit against the Defendant on April 29, 2013 against the Defendant on behalf of B, claiming for the amount of KRW 57,900,000 from January 31, 1974 for the agreed amount of KRW 57,900,000 and KRW 600,000 from October 31, 1974 for the agreed amount of KRW 30,000 from April 30, 197, KRW 2,000 from January 31, 197, KRW 6,000,000 from September 31, 1980 to October 31, 198, KRW 49,000 from October 31, 198, and damages for delay calculated at the rate of KRW 25,25,00 from October 31, 194.
C. In the above contract amount claim lawsuit, the issue was whether the Defendant’s signature entered in the bond statement No. 1 (hereinafter “instant bond statement”) held by B is the Defendant’s own seal. On December 12, 2013, the date of appraisal, the Defendant stated that the above Chinese signature is the Defendant’s own seal.
B On March 10, 2014, when the above contract deposit claim lawsuit is pending, B withdraws the above lawsuit with the defendant, and after this agreement, B confirms that there is no claim against the defendant regardless of the reasons therefor, but in particular, there is no right against the defendant in B based on the claim statement of this case.
