Reasons
Punishment of the crime
The defendant is a person who lacks the ability to discern things or make decisions due to intellectual disability that is merely about 45 degrees of the total intelligent index.
1. The Defendant is a person engaging in driving a B rocketing car.
Around 17:08 on March 24, 2020, the Defendant driven the above rocketing car and proceeded at the speed from the direction of the mid-gu Daejeon Central Police Authority to E at a sloping speed.
A person engaged in driving motor vehicles has a duty of care to prevent accidents by safely manipulating the brakes and steering gear.
Nevertheless, due to the negligence of neglecting this, the Defendant received the part of the part of the victim F (mae. 53 years old), who was standing in the rear of the Defendant’s driver’s car, in the front part of the GH car driven by the victim F (mae. 53 years old), and thereby damaged the repair cost equivalent to KRW 1,94,859, and continued to be parked in the front part of the Defendant’s driver’s car operation, and left the site without taking any measures by immediately stopping the part of the first part of the 1,903,529, which was owned by the victim H (ma, South, 49 years old) who was parked in the front part of the Defendant’s driver’s car operation.
2. The Defendant violated the Road Traffic Act (unlicensed Driving) driving a B rocketing car as described in paragraph 1 without a driver’s license at the time and place specified in paragraph 1.
3. At the time and place set forth in Paragraph 1, the Defendant illegally driven the said car as described in Paragraph 1 without obtaining the consent of the victim J, the owner of B rocketing car, as the owner of the said car.
