A Co., Ltd. is a corporation established on June 4, 2009 for the purpose of building construction business, etc.; from around March 2, 2016 to around Jeju, it is a business owner who employs and executes workers under a contract for the construction of a multi-household housing building with the concrete structure near the first ground steel in Jeju city; Defendant E Co., Ltd. (hereinafter “former Co., Ltd”) is a corporation established on February 4, 2014; from March 2, 2016, it is a corporation established for the purpose of soil construction business, etc.; from around March 2, 2016, it is a business owner who hires and performs workers with the steel reinforced concrete construction among the construction of the said new building; Defendant B is a director at the construction site of the said new building; Defendant A is a manager at the construction site near the above steel concrete construction site with interest of the representative director at the time of Defendant E Co.,, Ltd.; Defendant C is a person who is in charge of safety and health affairs of Defendant E’s director.

In the event that Defendant A or C uses construction machinery of a vehicle in order to prevent hazards caused by improper working methods, etc. in the course of excavating, quarrying, unloading, timbering, transporting, operating, dismantling, handling heavy objects, and other operations, he or she shall conduct a prior investigation in the workplace, in order to prevent hazards to workers, prepare a work plan including the types and performance of construction machinery of the vehicle system used in consideration of the results of the investigation, the types of construction machinery in the workplace, work methods by vehicle meters, etc., and have the workers perform work in accordance with the plan. In the event that there is a concern that the workers might suffer hazards due to the collapse of the machinery, the leading person shall be placed, the prevention of the collapse of the side, the prevention of the collapse of the road, and the maintenance of the road width, etc.
