Defendant shall be punished by a fine of KRW 1,500,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is a member of the D church located in Seo-gu Daejeon, Seo-gu, Daejeon.

No one shall or shall have another person carry out an election campaign aiming at the members of an educational, religious, or professional institution or organization, taking advantage of any occupational act within the organization thereof, or aiming at an election campaign aiming at a business organization, enterprise, or its members, taking advantage of a special transaction status, such as systematization or subcontract, and no one shall carry out an election campaign using any recorder or video camera (including video and audio equipment) in a way other than the provisions of the Public Official Election Act during the election period.

Nevertheless, at around 11:50 on April 10, 2016, the Defendant displayed the promotional image of the 20th National Assembly election for the National Assembly member, which is the number indicating the F Party, for the purpose of having the said believers support the F Party in the proportional representative election, using a video camera of 1,000 persons who did not register the said church with the election commission (2m each of street and length) at around 14:00, around 14:00. On the same day, the Defendant displayed the promotional image of the 20th National Assembly member by using a video camera of 10 minutes produced by the said F Party as a major policy. The Defendant displayed the said video image of the said 20th National Assembly member with the aim of having the said believers support the F Party in the proportional representative election.

Accordingly, the defendant, taking advantage of the position of the Diplomatic pastor, carried out an election campaign for the believers of the above church, and carried out an election campaign using a video recording machine in a way other than the Public Official Election Act.
