피고인은 2014. 1. 13. 19:41경 대구 중구 B아파트에 있는 피고인의 집에서 스마트폰을 이용하여 ‘카카오스토리’ 앱에 접속하여, 피고인의 친구인 C이 작성한 글에 피해자 D가 '카스에서 주절대는거보다 헌법소원 거는게 빠름다'라는 취지로 댓글을 달았다는 이유로 모두가 볼 수 있도록 공연히 'D^^;;; 애미뒤진새끼 ㅎㅂ'라는 댓글을 작성하는 방법으로 피해자를 모욕한 것을 비롯하여 이와 같은 방법으로 그 때부터 2014. 1. 18. 22:51경까지 별지 범죄일람표 기재와 같이 69건의 댓글을 작성하여 피해자를 공연히 모욕하였다.
