A as a local public official belonging to the Gwangju Viewing Province, served as the head of the Gwangju Viewing K Team from July 19, 2010 to December 31, 2012, and was in charge of conversion of mountainous district, collection of earth and rocks, and construction management in the Gwangju City.
Defendant
B was carrying out the construction of a house site for electric power generation in Gwangju City L, and the defendant C is the actual operator of (i) N who has carried out a house site for electric power generation in M M, and the defendant E is the head of (ii)O who has carried out a house site restoration work at the request of (i) N in Gwangju City M at the request of (ii) Ma in Gwangju City.
1. Defendant A
A. On April 19, 2012, Defendant A received a bribe from Defendant B, who had been performing the construction work for the creation of a house for electric source in Gwangju metropolitan City, by receiving the bribe from Defendant C with the transfer of KRW 45 million to the P Nonghyup Bank in the name of Defendant A’s PHy Bank used by Defendant A. (2) around May 9, 2012, Defendant A received the bribe from Defendant C with the transfer of KRW 45 million to the PHy Bank in the name of Defendant A’s use. A received the bribe from Defendant A in the process of performing the work for the completion of on-site restoration and on-site management from Defendant C, who was the operator of (main N) who had been performing the work for illegal soil and stone collection in Gwangju metropolitan City, as well as the request to the effect that “the bribe was transferred to the PHy Bank in the name of Defendant A.”
B. On June 18, 2012, Defendant A received a bribe with the offer of KRW 15 million from (15 million in handling the approval for completion of restoration work sites and on-site management affairs, and received the bribe from Party E, a director at the site of (main)O, who was in progress at the request of (main N) N to the R “R” restaurant located in Q of Gwangju City.
