Reasons
Punishment of the crime
1. On March 23, 2015, Defendant T and A made a false statement in collusion with Defendant T and C to the “M” bank located in Daegu Dong-gu L, Daegu-gu L, stating that “http” (http:/naver.com/joint venture) is connected to the Internet intermediate trading site, and on the bulletin board, the victim who reported and contacted the fact that “on the transfer of the price of the goods, you will send the Not North Korea.”
However, Defendant T and A did not have the intention or ability to send Nowon-gu.
Defendant
T and A received 300,000,000 won from a post office account (Account Number:V) in the name of the Defendant T from the victim and received the total sum of 1,100,000 won from that to March 25, 2015 in the same manner as in the annexed crime list.
Accordingly, in collusion with A, the defendant T received a total of KRW 1,100,000 from the victims.
2. In using and managing the means of access, no person may transfer the means of access unless otherwise specifically provided for in any other Act.
Defendant
R, on March 2015, to receive KRW 100,00 from the Daegu Dong-gu Q apartment 103 Dong-gu, 507, A and B, and to transfer a passbook, 1, 2, and 1,000,000 won connected to the Daegu Bank Account (Account Number: S) in Defendant R’s name.
Accordingly, Defendant R transferred the means of access to electronic financial transactions to another person.
