The defendant's appeal is dismissed.

1. The gist of the grounds of appeal is that the Defendant and the victim lose their center and fell down under a rail in the process of the victim’s attempt to remove the two descendants of the victim by double hand, and the victim suffered bodily injury as stated in the facts charged during the process.

Therefore, the defendant's act constitutes a legitimate act as a passive resistance to prevent the other party's assault, and thus the illegality is excluded, and the judgment of the court below which found the defendant guilty of the defendant's bodily injury is erroneous in misunderstanding of facts or misunderstanding of legal principles.

2. 판단 원심이 적법하게 채택한 증거들에 의하여 인정할 수 있는 다음과 같은 사정들 즉, ① 피해자는 수사단계에서부터 원심 법정에 이르기까지 ‘자신이 난간에 등지고 있는 상태에서 피고인과 서로 치고 받고 하다가 다리가 들리면서 자신과 피고인이 함께 떨어진 것 같다’고 비교적 일관되게 진술하고 있는 점, ② 당시 피고인과 피해자의 싸움을 목격하였던 증인 F 역시 원심법정에서 ‘피고인과 피해자가 서로 옷을 잡고 당기고 미는 상황에서 담장 뒤로 둘다 훌쩍 넘어갔다’고 하여 피해자의 진술에 부합하는 증언을 하고 있는 점, ③ 피고인 스스로도 경찰 조사에서 ‘피해자와 서로 밀고 당기고 하다가 얼떨결에 담벼락으로 함께 떨어졌다’고 한 점 등에 비추어 보면, 피고인이 피해자가 자신의 멱살을 잡는 것을 뿌리치기 위한 과정에서 소극적으로 저항하였다

Therefore, the judgment of the court below that recognized the defendant's act as a legitimate act and found the defendant guilty is just, and it is erroneous or erroneous.
