The defendant shall be innocent.
Reasons
1. Summary of the facts charged
A. The Defendant violated the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Misappropriation of Trust) is the regular director of the E Union located in the petition-gu Seoul Metropolitan Government (hereinafter “E”), from March 30, 2006 to March 31, 201, the Defendant is a person in charge of general affairs, such as bond management at the E Science Complex Branch in F, while working as a regular manager at the E Science Complex Branch in F, and risk management.
On August 18, 2009, H’s representative director of the Victim G Co., Ltd. (hereinafter “G”) lent KRW 1.25 billion to I at the E Scientific Complex branch, and he/she shall be paid KRW 1.42 million including the principal and interest of the above loan, within two months. G has completed the provisional registration of the right to claim ownership transfer (hereinafter “the provisional registration of this case”) in the name of J or in the building of Chungcheongnam-gu, Chungcheongnam-do, Ha (hereinafter “instant building”). If I fails to repay his/her obligation within the said period, he/she agreed to make the provisional registration of this case, and then, on the 24th of the same month of the same month, lent KRW 1.25 billion from the above branch.
Afterward, around October 29, 2009, the Defendant and I would like to obtain the instant building as collateral and pay KRW 1.1 billion to H at the above branch of H first if it is difficult to repay the full amount of KRW 1.42 million. If the provisional registration of this case is terminated, the Defendant and I would like to clean up the security, etc. set forth in subparagraphs 301 and 401 of this case, and complete the registration of ownership transfer in the name of G with H as its representative director, by calculating the total amount of KRW 390 million, KRW 780 million,000,000,000 in total, and KRW 301 and 401,00,000 in total, and KRW 320,000,000,000,000 in total, and KRW 301,000,000 in total,00 in the name of H and KRW 301,40,000,00.
