A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 야간건조물침입절도 피고인은 2019. 11. 13. 06:54경 서울 용산구 B에 있는 피해자 C이 관리하는 D 주점에 이르러 위 주점의 시정되지 않은 출입문을 열고 내부로 침입하여 그곳에 있던 피해자 소유인 양주 여러 병(‘시가 65,000원 상당의 크라운로얄 양주 1병, 시가 117,000원 상당의 포폭스 사케 1병, 시가 68,000원 상당의 조니워커 블랙 1병, 시가 98,000원 상당의 발베니 양주 1병, 시가 90,000원 상당의 멕켈란 양주 1병’ 중 일부)을 가지고 나와 절취하였다.

2. On November 13, 2019, at around 09:22, the Defendant: (a) opened an entrance that was not corrected at the said main points; and (b) opened the inside, and intruded into, the said main points, and stolen the building; (c) owned several bottles (part of the remaining part of the two main points indicated in paragraph (1)) owned by the victim; and (d) stolen the building.
