A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
1. Around 09:30 on February 19, 2015, the Defendant driven a CM3 car while under the influence of alcohol with a blood alcohol concentration of 0.192% from the shooting distance prior to the Jinjin Elementary School located in the Jinjin-Jinjin-Jininjin-gun, Youngnam-gun, Youngnam-do.
2. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Doing Vehicles) and the Road Traffic Act (Non-accidenting Measures) are those engaged in driving of CM3 Motor Vehicles;
The Defendant, while under the influence of alcohol as above, driven the said car under the influence of alcohol, led to the driving of the said car at a speed of about 70km from the side of the week to the direction of the Jinjin Elementary School as stated in paragraph (1).
At this point, the signal apparatus is an intersection installed, and there was another motor vehicle in the atmosphere of signal at the front, so there was a duty of care to reduce the speed to those engaged in driving of the motor vehicle and to ensure the safe driving of the signal apparatus with the signal apparatus.
Nevertheless, under the influence of alcohol, the Defendant was found to be late behind the signal signal-based vehicle due to negligence in driving, and was driven by the victim D(the age of 27) who stops in front of the Defendant’s car without stopping even though the Defendant was able to stop.
Ultimately, the Defendant did not, by such occupational negligence, inflict an injury on the victim D, such as salt, tensions, etc. in need of treatment for about two weeks, inflict an injury on the victim F (the age of 27) who was accompanied by the said SPP car on the victim F (the age of 27) by the said SPP car for about two weeks, such as clocks, tensions, etc. in need of treatment for about two weeks, and then did not take necessary measures such as providing relief to the victim G (the age of 57) by stopping immediately.
