Defendant
A shall be punished by imprisonment for six months.
However, with respect to Defendant A, the above punishment shall be imposed for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Defendant A and Defendant B’s joint crime committed the following: (a) Defendant A served as the head of the E community belonging to the victim-affiliated group from July 1, 2007 to July 27, 2009; and (b) Defendant B was a public official affiliated with the granting group of victims from July 1, 2007 to January 17, 2010, who is a public official affiliated with the granting group of victims, engaged in the execution of G management subsidies entrusted to F by the victim-affiliated group.
On July 18, 2007, the Defendants conspired to deposit KRW 80,000,000 of the G management subsidy in the name of the victim for the victim at the NA E office of the NA in the Dong-dong Dong-Eup, Chungcheongnam-do, the Dong-gun, the Dong-gun, where the victim used F, deposited KRW 5,00,00 for the victim, and then deposited the first equipment from the I to the Agricultural Cooperative under the above I as if he leased the first equipment from the I, then then then he returned it again from the I to the I, and then embezzled it by arbitrarily consuming from the members of the Dong-gun, for any purpose other than G management, such as meal expenses.

2. Defendant B, from July 1, 2007 to January 17, 2010, was engaged in the execution of G management subsidies entrusted to F by the victim-affiliated group as a public official belonging to the granting group of victims.
On August 4, 2009, the Defendant deposited KRW 114,000,000 of the G management subsidy in the name of the victim for the victim at the Dong-dong E Office in the Chungcheongnam-dong Dong-dong, Chungcheongnam-dong, Chungcheongnam-do, the Defendant deposited KRW 400,00 in the passbook (Account Number N) in the name of Ler M as if he paid personnel expenses to Ler, and then arbitrarily consumed it from Ler’s members for any purpose other than G management such as parliamentary expenses.
