A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
From August 17, 2007 to December 9, 2014, the Defendant worked for the Victim D Co., Ltd. located in Jeju City from around August 17, 2007, and was in charge of the above C’s accounting affairs and the victim’s “Council of D Employees” management affairs.
1. On January 1, 2010, the Defendant: (a) opened a receipt of KRW 135,000 in cash, while withdrawing 135,00 in cash, while working in the office of the said victim Co., Ltd. D office, which was located in the first instance patrolman C, from the Defendant’s office located in the victim Co., Ltd. D; and (b) opened a receipt stating the details of the use thereof on behalf of the said victim; and (c) used them for personal purposes, such as living expenses, repayment of loans, and payment of installment payments, etc. at around that time.
In addition, during the period from around that time to November 19, 2014, the Defendant embezzled total of KRW 189,308,230 in the same way from Jeju-do Council members through the same method 810 times, such as the list of crimes (Ⅰ) in attached Form 1.
2. On September 1, 2008, the Defendant deposited 1,000,000 won in cash in the agricultural bank account (G) and the company bank account in the name of the Defendant, and immediately deposited 1,000,000 won in the agricultural bank account and the company bank account (H) in the above offices of the victim D Co., Ltd., Ltd., Ltd., located in Jeju, which deposited 1,00,000 from the above offices of D Co., Ltd., Ltd., Ltd., the Defendant deposited 1,00,000 won in cash and the card for the above victim.
In addition, from around that time to April 14, 2014, the Defendant embezzled the total of KRW 32,060,000 by the same method from Jeju-do Day through the same 29 times, such as the list of crimes (Ⅱ) in attached Form 2, from around that time to around that time.
