1. The Defendant shall pay to the Plaintiff KRW 33,423,161 and the interest rate of KRW 15% per annum from January 9, 2016 to the date of full payment.

1. Basic facts

A. The Defendant purchased B Tourist Vehicles under the name of the Plaintiff and entered the Plaintiff. In the process, on February 28, 2013, the Defendant borrowed KRW 49,00,000 from Hyundai Social Co., Ltd. in the name of the Plaintiff with a loan period of KRW 48 months, monthly installments of KRW 1,336,541 (the first month was KRW 1,429,842).

B. However, the Defendant failed to pay the above installment, and the Plaintiff paid KRW 29,497,203 on April 5, 2013, including KRW 28,067,361 (i.e., KRW 1,336,541 x 21 month) from May 5, 2013 to January 5, 2015.

C. During the demand for the payment of installments, etc. to the Defendant, the Plaintiff received a funding plan from the Defendant that “The Plaintiff would pay KRW 16,862,099 on August 25, 2014 and KRW 10,862,09 on September 25, 2014, in total, KRW 16,862,09 on September 25, 2014.” As of November 18, 2014, the Plaintiff received a financing plan to the effect that “The Plaintiff would pay KRW 5,00,000 until November 29, 2014, KRW 1,500,000 until December 8, 2014, KRW 13,000,000 until December 30, 2014, and KRW 13,000,000 on a regular loan account.”

If the Defendant did not pay the money pursuant to the above agreement, the Plaintiff recovered the said vehicle together with the Key Repair Service on December 31, 2014.

E. On September 29, 2015, the Plaintiff sold the instant vehicle to C in KRW 12,00,000 and completed the registration of transfer. On the other hand, on October 1, 2015, the Plaintiff paid KRW 22,279,368 of the remainder of the payment remaining in relation to the instant vehicle.

F. From March 12, 2013, the Plaintiff paid KRW 4,345,240, a sum of KRW 1,783,570, and KRW 1,783,570, which was terminated from March 12, 2014 to January 13, 2015.

G. Furthermore, among the charges imposed on the instant vehicle, the Plaintiff’s totaling KRW 16,210 for September 11, 2013, KRW 193,080 for March 2014, KRW 196,030 for September 194, and KRW 196,030 for March 195, and KRW 196,030 for March 2015 (limited to the period of imposition, from July 1, 2014 to December 31, 2014).
