1. The Defendant’s KRW 964,051,930 for the Plaintiff and its related KRW 6% per annum from September 1, 2018 to June 14, 2019, and June 15, 2019.
Reasons
1. Basic facts
A. The plaintiff is a corporation established for the purpose of real estate rental business, etc., and the defendant is a housing redevelopment and consolidation project association established for housing redevelopment and rearrangement project (hereinafter “instant rearrangement project”) covering the Seo-gu Seoul metropolitan district under the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents.
B. On April 2, 2015, D Co., Ltd. (hereinafter “D”) concluded an agency service contract (hereinafter “instant service contract”) with the Promotion Committee of Regional Housing Association and the Promotion Committee of the Promotion Committee of the instant regional housing association to receive service fees after being entrusted with all duties following the implementation of the instant improvement project. After obtaining authorization for the establishment, the Defendant succeeded to the rights, duties, and contractual status of the said Promotion Committee regarding the instant service contract.
The main contents of the instant service contract are as follows.
However, on December 28, 2015, D and the defendant changed the interest rate of Article 6(3) of the instant service contract from 2.5% per annum to 24% per annum (2% per annum) on December 28, 2015, and applied the changed interest rate retroactively to the first loan date.
B The chairperson of the Regional Housing Association Promotion Committee (hereinafter referred to as "A") and D representative E (hereinafter referred to as "B") shall conclude a regional housing association agency service contract as follows:
Article 2 (Scope and Duties of Services)
1.The duties entrusted by “A” to “B” are:
1) Related work (Establishment, Change, Dissolution, Liquidation, etc.) 7) Services related to the authorization of the housing association (approval) design and authorization and permission, cooperation in the work of land in the project area and in the registration-related work (payment of land work costs separately), 8) design and authorization, installation and operation expenses of a model voucher (payment of rent, electricity, management fee, etc., land agreement amount, land contract amount, land service cost, advertisement and publicity expenses, expenses for project promotion, etc. “B” shall be subsidized and “A” shall be subsidized and “A” after authorization of the establishment of a regional housing association is granted.
