Punishment of the crime

On May 6, 2008, the civil society organization organized the National Countermeasure Council (hereinafter referred to as the “Measures Council”) with a view to organizing a strike against full import of U.S. beef, claiming that “the phase-out expansion agreement of U.S. beef import concluded with the Government on April 18, 2008 would cause harm to the people’s health as well as the stroke negotiation,” and that “the National Countermeasure Council (hereinafter referred to as the “Measures Council”) against the full import of U.S. beef at risk.”

Since May 2, 2008, the countermeasures conference led to the ‘candlelight flelelight meeting against the import of American beef in Jongno-gu Seoul Metropolitan Government, etc.' which was held in the Cheongyang-dong, Jongno-gu, Seoul. On May 6, 2008, the countermeasures conference held a candlelight meeting which is an outdoor assembly after sunset from the candlelight square on a day from May 6, 2008. From May 24, 2008, the countermeasures conference tried to move into the Cheongbu, etc. in the city of the following day after the candlelight assembly and the following day from May 24, 2008.

Accordingly, the government has made an additional negotiation on the import of U.S. and beef, and announced the result of the additional negotiation on June 21, 2008, but the countermeasures conference continued to hold a candlelight demonstration at night in order to accept it and to pressure the government by asserting the complete renegotiation of conditions.

On June 27, 2008, from around 19:15 to 20:20, the countermeasures conference held a candlelight meeting in the presence of 3,50 people on the front side of the Taeduk Kuk-gu in front of the Taeduk-do.

In addition, the above 3,500 persons occupied the entire lanes from 20:20 to 06:10 on June 28, 2008, such as Sejong-ro, B-ro entrance, chilling, species, and the front of the hotel, and conducted a demonstration.

At around 22:40 on June 27, 2008, the Defendant engaged in demonstration, such as moving roads in Korea and in front of the hotel, moving the roads before Korea and the hotel.
