The prosecution of this case is dismissed.

1. 공소사실의 요지 피고인은 2018. 3. 5.경 불상지에서 B 단체채팅방 ‘C’에서 피해자 D을 지칭하여 “목회자란뇬이 집사글 펌해서 지글처럼 올리네!!! 목회자가 글 적을 줄 모르나봐!!.. 집사글 펌하네!!! ㅋㅎ”라고 욕설한 것을 비롯하여, 그 무렵부터 2018. 3. 7.까지 별지 범죄일람표 기재와 같이 총 5회에 걸쳐 피해자에 대한 욕설을 게시함으로써 공연히 피해자를 모욕하였다.

2. This part of the facts charged is a crime falling under Article 311 of the Criminal Act, which can be prosecuted only when a complaint is filed under Article 312(1) of the Criminal Act. Since a letter of revocation of a complaint filed by the complainant was submitted to this court on May 28, 2019, the prosecution of this case is dismissed in accordance with Article 327(5) of the Criminal Procedure Act.
