Punishment of the crime

[criminal power] On November 22, 2018, the Defendant was sentenced to one year and six months of imprisonment and three years of suspended execution under the Act on the Safety Management of Firearms, Swords, Explosives, Etc. in the Seosan Branch of the Daejeon District Court on November 2, 2018, and the judgment became final and conclusive on November 30, 2018.

【Criminal Facts】

1. A person who intends to operate a manufacturing business of guns in violation of the Act on the Safety Management of Guns, Swords, Explosives, Etc. (including parts of guns, such as guns, machine parts, shot cartridges and ball cartridges, noise engines, and illuminations) due to the manufacture of unauthorized guns shall obtain permission therefor from the Commissioner General of the National Police Agency for each factory, as prescribed by Ordinance of the Ministry of Public Administration and Security, and shall not manufacture guns unless he/she has obtained

The Defendant, without obtaining permission from July 2015 to August 2018 of the same year, obtained the manufacturing method of noise apparatus at the Defendant’s residence located in Jinjin-si B apartment C through the Internet website, and manufactured two noise equipments by combining the noise equipment parts purchased by requesting two metal processing companies located in Geumcheon-gu Seoul, Geumcheon-gu, Seoul.

Accordingly, the Defendant manufactured noise machinery, which is part of guns, without obtaining permission.

2. Among guns in violation of the Act on the Safety Management of Firearms, Swords, Explosives, Etc. due to possession of gun parts without permission, a person who intends to possess a hunting gun, gas discharger, air gun, narcotics, slaughter gun, industrial gun, industrial gun, rescue and life gun, or parts thereof shall obtain permission from the chief of a police station having jurisdiction over his/her domicile;

Despite the revocation of permission for possession of a gun around October 11, 2018, the Defendant without permission, and without permission from October 11, 2018 to May 31, 2020, 1 cross-light (Sungdo 4-12X40) of air gun parts in the Defendant’s parent warehouse located in Cheongyang-gun-gun, Chungcheongnam-do Cheongyang-gun, and 3 cross-lights (Bushntell 4-12X401, Swift 4.5-1441, Swift 1441, AR 14-241), and G. owned by the Defendant.
