A defendant shall be punished by imprisonment for six months.

Reasons

Punishment of the crime

On January 19, 2015, the Defendant was sentenced to 15 years of imprisonment with prison labor by the Changwon District Court for murder, etc., and the said judgment became final and conclusive on April 16, 2015.

1. A thief (1) around 04:00 on August 25, 2014, the Defendant: (a) fell under Ctel 930, which is the Defendant’s residence located in Seongdong-gu, Changwon-si; (b) died of a female living together with a kitchen knife with the victim’s knife; and (c) stolen one copy of the Samsung Card and Hyundai Card, which is the victim’s ownership, and one copy of the said victim’s knife.

(2) On the same day as in the preceding paragraph, the Defendant: (a) stored the Samsung Card owned by the victim’s new bank in an automatic cash payment machine managed by the victim’s new bank as above; and (b) withdrawn a total of KRW 1.6 million in cash, which is the victim’s possession, for cash services.

(3) On August 27, 2014, the Defendant: (a) laid down a stolen modern card in a cash automatic machine managed by the Defendant (hereinafter “victim”); and (b) removed a password, and then withdrawn KRW 1,200,000,000,000 for cash services owned by the victim.

2. On August 25, 2014, the Defendant: (a) purchased oil equivalent to KRW 80,000,000, which was operated by the victim’s false names; (b) and (c) presented the instant stolen Samsung Card as if the Defendant was owned by the Defendant, thereby deceiving the victim; and (c) acquired pecuniary benefits equivalent to KRW 80,00,000 by deceiving the victim by doing so

In addition, the Defendant, by deceiving the victims by such means as above, obtained a total of KRW 2,715,890 from around that time to September 14, 2014, as shown in the separate crime list.

3. The Defendant in violation of the Specialized Credit Financial Business Act used stolen credit cards, such as paragraphs (2), (3) and (2).
