Reasons
Punishment of the crime

The Defendant, from May 13, 2008 to January 13, 2014, served as the representative director of the victim Indonesia Corporation D (hereinafter “victim Company”) and was engaged in the management of the victim company and fund management.
The defendant had a duty to operate the company normally as the representative director of the victim company and to manage employees and funds faithfully so as not to interfere with the performance of duties.
Nevertheless, on December 23, 2013, the Defendant violated his duties, stating that “retirement consolation benefits may be paid to the local employees of the victim company upon retirement due to the date of the increase in the number of days” to the local employees of the victim company, and the Defendant would be able to do so by leaving the headquarters in the future in negotiations with E, thereby leaving the company back to the same place.” On December 24, 2013, after receiving a written resignation from the local employees of Indonesia and receiving a written resignation from the Indonesia and processing retirement as retirement consolation benefits, the Defendant paid 32,00,00 IDR (Korean approximately KRW 2,832,00,000) as retirement consolation benefits to G on the same day, and paid 30 local employees as shown in the attached list of crimes.
