The judgment of the court below is reversed.
A defendant shall be punished by imprisonment for one year.
However, for a period of two years from the date this judgment becomes final and conclusive.
Reasons
1. The sentence imposed by the court below (one year of imprisonment) on the summary of the grounds for appeal is too unreasonable.
2. Determination
A. Determination 1 as to whether there was deception. The summary of the facts charged of this case is that at the time of entering into a lease contract for multi-household houses with each victims, each part of the lease was illegally remodeled into three rooms and was ordered to restore them to the original state. Since there were many other lessees who have no sufficient means to pay the amount of transfer income tax and have to return the deposit money, the victims did not notify the victims of the fact that the above multi-household house had no intention or ability to return it even if they were paid the deposit, and instead, by deceiving the victims by explaining that the above multi-household house was a building without any defect. 2) First, we examined the issue of whether the Defendant was deceiving by not notifying that the leased object of this case was illegally opened, and the following circumstances acknowledged by the evidence duly admitted and investigated by the court below, and the lease contract of this case was divided into 20G 10 and 14, 10, 20, 10, 27, 10, 20, 10, 27, 4, 1, 2, 2, 3, 1, 3.
