A defendant shall be punished by imprisonment for two years.
The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.
Reasons
Punishment of the crime
1. On July 4, 2018, the Defendant forced indecent conduct 00:47, U.S. and U.S.A. 437-3 consular street, U.S., Nam-gu, U.S., and U.S. 437-3, U.S., U.S., and placed a vehicle on alleyway near the E hospital located in Ulsan-gu, U.S. and U.S., U.S. as passengers on the same day.
At around 01:24 on the same day, the Defendant: (a) boarded tobacco at the driver’s seat of the above taxi, and boarded at around 01:25 at the back of the taxi; (b) 01:26, the Defendant, under the influence of alcohol, had the victim, who is difficult to make a normal judgment, move to the back of the driver’s seat of the taxi that is not opened on the inside and outside of the taxi; (c) released the Defendant’s Hext and panty; and (d) made the Defendant’s Hext and panty so that the victim can smoothly move to the back of the taxi.
At around 02:00 on the same day, the Defendant knew that the victim did not open the door of a taxi to a certain degree, and that the defendant was seated next to the defendant while standing his sexual organ, and had the victim crypted with the sexual organ, and 10% of the amount of the defendant's sexual organ at hand.
Accordingly, the defendant committed an indecent act against the victim.
2. At around 02:14 on the same day, the Defendant: (a) allowed the victim C to leave the taxi at around 02:14, “the victim C to leave the taxi so that it can do so,” and (b) the victim took a bank and mobile phone inside the taxi to provide an opportunity to flee from the taxi without suspicion of the Defendant, and (c) went to the F convenience store located at about 200 meters away from the taxi.
The Defendant reported the dispatch of the police officer in the vicinity of the above convenience store on the same day, and the victim gets a cell phone or a bank owned by the victim from leaving his/her taxi to an insular place on the same day, and 02:37 on the same day, and 02:37 on the same day, received the phone from the police officer who was suffering from the cell phone located between the victim and the victim.
