The sentence of each sentence shall be suspended against the Defendants.

Punishment of the crime

1. Defendant A

(a) Any person who intends to carry on a business of manufacturing and processing unregistered foods, a business of manufacturing and processing food additives, or a business of manufacturing and processing food additives, shall register his/her business with the competent authority;

Nevertheless, from January 20, 201 to June 23, 2014, the Defendant, without registering the business, stored the original by-products in the kitchen in Yeongdeungpo-gu Seoul Metropolitan Government D containing the liverer, i.e., original wood, original head, etc., in the kitchen, etc., and manufactured safs by inserting them into the kitchen, and manufacturing the safs by inserting the original by-products into the original oil from the original oil from which he lives.

Accordingly, the defendant operated food manufacturing and processing business and food additives manufacturing business to the competent authorities without registering it.

(b) No one shall sell, or collect, import, process, use, cook, store, transport, display, etc. for the purpose of sale, foods, etc. manufactured, processed, subdivided, or sold by persons, other than business operators;

Nevertheless, from January 20, 2014 to June 23, 2014, the Defendant sold, prepared, and stored by-products manufactured as above at two places of business reporting general restaurant business in Yeongdeungpo-gu Seoul, Yeongdeungpo-gu and Yeongdeungpo-gu Seoul Metropolitan Government E and “G” food additives located in Yeongdeungpo-gu Seoul Metropolitan Government F, respectively, for the purpose of sale.

2. No person who is not a business operator shall sell foods, etc. manufactured, processed or subdivided by any person, other than a business operator, or collect, import, process, use, cook, store, transport, display such foods, etc. for sale;

Nevertheless, from January 20, 2014 to June 23, 2014, the Defendant sold or used, cooked, and stored the original by-products manufactured as described in paragraph 1(a) at the business establishment reporting general restaurant business in Gwangjin-gu Seoul Special Metropolitan City, which was operated by the Defendant, as well as the original by-products manufactured as described in paragraph 1(a).
