A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a driver of Csi and the victim D (n, 26 years of age) is a Chinese national tourist who entered Jeju-do on December 18, 2013.

계속하여 피고인은 목적지인 중문색달해변에 도착하자 피해자에게 “가이드를 해주겠다”고 하면서 피해자를 따라나선 다음, 피해자의 손을 붙잡고, 피해자의 팔에 팔짱을 끼는 등으로 치근대며 걸어가다가 갑자기 피해자의 뒤에서 양팔로 피해자를 껴안고, 이에 피해자가 양손으로 피고인을 뿌리친 후 왔던 길을 돌아가자 재차 왼손으로 피해자에게 팔짱을 끼며 오른손을 피해자의 왼쪽 가슴 위에 얹고, 이에 피해자가 “하지 마요”라고 이야기하자 옷 위로 피해자의 양쪽 가슴을 훑어 내리듯 만지며 손을 내리고, 계속하여 피해자에게 목적지인 같은 시 중문동에 있는 중문우체국까지 태워다 주겠다며 피해자를 위 택시에 태워 목적지에 도착한 후, 택시에서 내리려는 피해자에게 “잠깐만”하면서 피해자를 안고 피고인의 왼쪽 얼굴 부분을 피해자의 왼쪽 뺨에 대고 비볐다.

Accordingly, the Defendant committed an indecent act on the part of the victim.
