All judgment of the court below shall be reversed.
Articles 8 and 12-A of the judgment of the court of first instance.
with respect to each of the crimes in this paragraph.
Reasons
1. Summary of grounds for appeal;
A. Defendant 1) misunderstanding of facts or misunderstanding of legal principles on the following grounds, the lower court erred by misapprehending the legal doctrine, thereby adversely affecting the conclusion of the judgment. (A) As to the fraud in relation to the case of “E” B (hereinafter referred to as “E”, including the foregoing B (hereinafter referred to as “E”), the trade name of “E” is omitted, and only the name specified in the regional name is indicated) when the Defendant entered into a contract with the victim F and the said victim, and thus, the contract with H, which the Defendant first entered into a contract with the said Defendant on the B points prior to entering into the contract with the victim F, was terminated at the request of H. Therefore, it was possible to enter into a contract with the said victim at the time of entering into the contract with the said victim on the B points.
(2) As to the fraud related to C Station, the victim F requested the defendant to introduce another store which is capable of raising more sales than B Station, and the defendant so that the above victim could transfer the store to C Station, so there was no fact that the defendant deceivings the above victim in relation to the transfer to C Station.
(3) On the other hand, the victim F requested another defendant to transfer the store from the K store to the K store after transferring the store to the K store. The main reason why the above victim wanted to move to the K store was not for the larger sales but for the convenience of his commuting to the K store.
(B) In addition, the victim F agreed to pay the defendant additional deposit in order to transfer the store to K store. Unlike the agreement, the above victim failed to prepare additional deposit, and the defendant was forced to operate K points temporarily.
B) As to the case No. 2019 Highest 1191, fraud against the victim B is committed.
