The sentence against the accused shall be set forth as six months of imprisonment and a fine of thirty million won.

The above fine shall not be paid by the defendant.

1. 공무집행방해 피고인은 2020. 7. 2. 23:39경 포항시 북구 B에 있는 ‘C’에서 손님이 편의점 종업원에게 욕설을 하며 시비를 건다는 112신고를 받고 현장에 출동한 포항북부경찰서 D파출소 소속 경장 E이 자신을 제지하자, 술에 취한 상태에서 위 E에게 “짭새는 빠져라 씨발놈들아”라고 욕설을 하는 등 계속하여 행패를 부려 현장에서 귀가조치 되었다.

이후 피고인은 이에 불만을 품고, 2020. 7. 3. 00:15경 포항시 북구 F에 있는 D파출소에 술에 취한 채로 찾아가 “개새끼야, 짭새새끼야, A4용지를 가지고 와라”라고 욕설을 하면서 소란을 피우고, 의자에 앉아 피고인의 말을 듣고 있던 위 E에게 다가가 시비를 걸며 오른손에 들고 있던 볼펜으로 위 E의 머리 부위를 수회 때려 폭행하였다.

Accordingly, the defendant interfered with legitimate execution of duties concerning prevention, suppression and investigation of crimes, such as handling of 112 reported cases by police officers.

2. 경범죄 처벌법 위반 피고인은 2020. 7. 3. 00:35경 위와 같은 이유로 현행범인체포되어 포항시 북구 중앙로 331에 있는 포항북부경찰서 형사과 사무실로 연행된 후, 경찰관을 향해 “야이 개새끼야, 이 병신새끼야, 짭새새끼야!”라고 계속하여 욕설을 하며, 자신의 성기를 꺼내어 사무실 바닥에 오줌을 누고 가래침을 뱉는 등 같은 날 01:55경까지 약 1시간 20분 동안 소란을 피웠다.

Accordingly, the defendant, while under the influence of alcohol, had a very rough and disorderly speech and behavior in a public office.
