1. Of the instant lawsuit, the Plaintiff’s lawsuit against Defendant AH and the real estate indicated in [Attachment 1] Nos. 17 and 18 of the real estate list.

1. Basic facts

A. On April 16, 2010, the Plaintiff was declared bankrupt on April 16, 2010 by Jeju District Court 201Hauhap1, and the Plaintiff was appointed as the trustee in bankruptcy of the highest mutual savings bank.

B. Defendant A Co., Ltd. (hereinafter “Defendant A”) is the original acquisitor who newly built each real estate listed in the separate sheet of real estate (hereinafter “the instant building”) as indicated in the separate sheet of real estate (hereinafter referred to as “the instant building”), and the Defendant AC Development Co., Ltd. (hereinafter “Defendant AC Development”) was awarded a contract on January 17, 2002 with AO large 481.4 square meters, AP large 482.1 square meters, which is the site of the instant building, and entered into a contract on February 18, 2002 to purchase the instant building that was newly constructed by Defendant A at least 3 billion won.

C. On March 20, 2002, the best mutual savings bank leased KRW 4 billion at the interest rate of 15% per annum, 21% per annum, and due date of payment on March 20, 2003. As to the building and site of this case as security for the above loans between the Defendant Loc Development and the Defendant Loc Development, when it is no longer possible to continue its business until June 20, 202 due to the failure to complete the construction of the building of this case or dishonor, etc., it shall deliver all documents necessary for the approval of the change of the business plan (including the change of the owner’s name) to the est mutual savings bank or the third party designated by the Excellent Mutual Savings Bank. In transferring all of the construction results (including buildings, materials, etc. under construction), Defendant Loc Development and the Excellent Mutual Savings Bank concluded a security interest in the transfer of this case with the content that it does not raise any objection (hereinafter “this case’s transfer security interest”).
