Reasons
Punishment of the crime
The Defendant, as the representative director of the F Co., Ltd. in Ulsan-gu E (hereinafter referred to as “F”), was the Defendant, from June 2007, entered into a contract with H (hereinafter referred to as “victim Co., Ltd.”) located in Yangsan-si on or around March 4, 2010, and produced and supplied the Victim Co., Ltd. (hereinafter referred to as “the instant parts”), which is part of the exhaust gas relar, used in the diesel engine. The Victim Co., Ltd. manufactured I using the instant parts supplied by F and supplied them to the Victim Co., Ltd. (hereinafter referred to as “the instant parts”). The Victim Co., Ltd. manufactured I using the instant parts supplied by F and supplied them to the Victim Co., Ltd. (hereinafter referred to as “Co., Ltd.”).
The Defendant, on June 2014, 2014, expressed his intent to suspend the delivery of the instant parts to the victim company by using the fact that F was unable to deliver the instant parts to the victim company unless the F did not supply the instant parts to the victim company, and ultimately, was charged with the victim company with heavy liability for damages caused by the failure to deliver the instant parts to the victim company. As such, the Defendant was willing to keep the victim company from delivery of the instant parts.
At around 08:00 on July 2, 2014, the Defendant notified the suspension of the supply of the instant parts by sending an e-mail to the victim company, and suspended the delivery of the instant parts for three days from that time to April 2, 2014, under the title of “request for improvement of unfair trade,” and “F incurred loss by engaging in unfair conduct by H, such as creaming, double development, and raw materials sales.”
On the 4th day of the same month, the Defendant concealed the core gold model in F near the F, among the gold type necessary for the production of the instant part, which was kept in F, in the possession of the victim company, and the same month.
