The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. In fact, when the Defendant was assaulted by the victim of his/her or his/her father and his/her wife, the Defendant was merely a son who saw clothes to defend him/her. Therefore, the Defendant did not have the intent to injure the Defendant, or the Defendant’s act constitutes a legitimate defense or legitimate act.

In doing so, the lower court found the Defendant guilty of the facts charged of this case, which erred by misapprehending the legal doctrine or by misapprehending the legal doctrine, thereby adversely affecting the conclusion of the judgment.

B. The sentence of the lower court that is unfair in sentencing (an amount of five million won) is too unreasonable.

2. Determination

A. 1) The judgment of the court below on the assertion of misunderstanding of facts or misunderstanding of legal principles 1) The defendant argued that the defendant did not have an intention to inflict bodily injury on the victim, or that the defendant's act constitutes a legitimate defense or legitimate act.

On the grounds delineated below, the lower court rejected all of the Defendant’s assertion.

A) The following facts are acknowledged based on evidence duly adopted and investigated by the lower court on the assertion that the victim had no intention to inflict injury on the victim, and in particular CCTV images.

㉠ 피고인의 왼쪽 어깨와 피해자의 오른쪽 어깨가 가깝고 피고인의 오른쪽 어깨와 피해자의 왼쪽 어깨가 먼 상태로 피고인과 마주 서 있던 피해자가 먼저 오른손에 진 분홍색 옷을 든 채로 자신의 오른쪽 어깨 위로 손을 올렸다가 피고인의 왼쪽 어깨와 얼굴 방향으로 진 분홍색 옷을 내려치듯이 휘둘러 피고인이 왼쪽 얼굴 부위를 위 옷으로 덮듯이 맞게 되었다( 영상시간 05:11 :52PM). ㉡ 이에 피고인이 오른손에 연분홍색 옷을 손에 쥔 채로 자신의 오른쪽 어깨 앞 얼굴 높이로 손을 올린 다음 피해자의 얼굴이 있는 왼쪽 앞 방향으로 1회 휘두르고( 영상시간 05:11 :53PM), 다시 오른손을 피고인의 왼쪽 어깨 위로 들었다가 피해자의 얼굴이 있는 오른쪽 앞...
