1. Basic facts

A. On January 26, 1931, the transfer registration for ownership was made on January 20, 1931 in the F, which was residing in the “E” on January 26, 1931, and on December 31, 1969, the ownership transfer registration was made on March 25, 1950 on the part of the Defendant on December 31, 1969.

On December 27, 1975, the land before subdivision was divided into 2,103 square meters (6,952 square meters), 122 square meters (403 square meters) and 21 square meters (69 square meters) prior to G, and at the same time the land category of the said H was changed into “road”. The said G land was divided into 6,896 square meters prior to G on October 13, 1983, and the land category of the said J land was changed to “road” at the same time.

Since then, each of the above lands became each land listed in the separate sheet after the change of administrative district, etc. (hereinafter referred to as "each of the above lands").

B. It is written by K residing in C and F residing in C in C, respectively, at the time of subdivision, which was enacted and enforced by Act No. 31 of June 21, 194, and was repealed by Act No. 4817, Dec. 22, 1994; hereinafter the same shall apply) of the former Farmland Reform Act (amended by Act No. 4817, Dec. 22, 1994; hereinafter the same shall apply).

The statement of the details of repayment of the waived farmland before partition, the statement of the waived farmland inundation, and the statement of the permit for the renunciation of farmland is also written by K residing in Criri even in the column of the "person who is a recipient of the farmland."

In the land cadastre and the register comparison register concerning the land before partition, the "farmland sheet" is written by F residing in C as the owner, and K residing in C as the distributor, respectively.

On September 7, 1968, the Jeju Special Self-Governing Province submitted to the Minister of Agriculture and Forestry on September 7, 1968 a detailed statement of acquisition of farmland and a list of farmland subject to registration of state-owned farmland attached to the detailed statement of acquisition of farmland subject to registration.
