A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal history] The Defendant has the record of having received a summary order of KRW 1 million from the Changwon District Court’s branch office around November 30, 2016 to the offense of violating the Game Industry Promotion Act; and on August 16, 2017, the same court issued a summary order of KRW 3 million to the offense of violating the Act on Special Cases concerning Regulation and Punishment of Speculative Acts.

[Criminal facts]

1. A person who intends to run a game providing business without registration shall prepare certain facilities and register with the competent authority;

Nevertheless, from March 2017 to August 1, 2017, the Defendant: (a) operated “D” located in the fifth floor of the building in Tong Young-si from March 2017; and (b) installed and operated a three game software machine without being registered with the competent authority; and (c) provided the said game water to unspecified persons.

In this respect, the defendant run a game providing business without being registered with the competent authorities.

2. No game products-related business entity that provides game products with contents different from the rating received shall provide such game products for the distribution or use of, or display or store for, a game product with contents different from the rating received by the Committee on Water Management;

Nevertheless, at the time and place specified in the above paragraph 1, Defendant 1 set up three games as classified by the Committee on Water Management (SAWR) 2020 games and provided them for the use of customers, and the game was carried out in the form of a common game six consecutive times, and if a certain picture, such as overwork, is arranged on the screen of the game machine, the game machine is converted to the water (FNNNNNNNOWER).

As a result, the Defendant provided customers with game water different from the rating of the game water management committee.
