피고인은 2016. 8. 초순경 인터넷에서 ‘일당 30~40만 원을 벌 수 있는 알바가 있다'는 구인광고를 보자 거기에 나와 있는 ’위챗' SNS 아이디를 자신의 위챗 어플리케이션에서 친구로 추가한 다음, 전화금융사기 범행을 계획하고 있던 ‘D~’라는 대화명을 사용하는 성명불상자로부터 “퀵 기사로부터 체크카드를 받아 그 카드로 현금을 인출하고 인출금액의 4%를 뗀 후 내가 말해주는 계좌번호로 송금해 주면 된다.”는 내용의 제안을 받았다.
