1. The plaintiff's claim is dismissed.

Details of the disposition

The status B of the parties is a female student attending the third grade of C Elementary School in the second grade and D is a male student attending the second grade of C Elementary School in the second grade of C Elementary School, and the plaintiff is the mother of B.

On February 9, 2019, D, such as the case of transmission of sexual photography and the holding of the first autonomous committee on countermeasures against school violence, sent to B a copy of a photo of the body photo, one of which is marked with the word “in-house garment” (hereinafter “the case of transmission of sexual photography”), and the Plaintiff reported to C Elementary School Head as school violence on the above activities of D.

Accordingly, the head of the C Elementary School decided to hold an autonomous committee for countermeasures against school violence (hereinafter “the first autonomous committee”), and the committee for countermeasures against school violence was held on February 15, 2019 by seven incumbent members, among nine incumbent members, on which the committee for countermeasures against school violence was held on February 15, 2019. The autonomous committee assessed the detailed elements of the case for transmission of sexual photography as described in the following table and taken measures against D, “in writing” under Article 17(1)1 of the Act on the Prevention of and Countermeasures against School Violence (hereinafter “School Violence Prevention Act”).
