All of the prosecutions of this case are dismissed.

1. The Defendant is a person who runs an online shopping mall Co., Ltd. by employing 20 full-time workers under Article 905 of Yongsan-gu Seoul Metropolitan Government building B.

A. The Defendant in violation of the Labor Standards Act, while working in the foregoing company from December 11, 201 to August 11, 2014, did not pay KRW 751,667 of the wages of the retired worker D as of August 2014, within 14 days from the date of retirement without any agreement on the extension of the due date between the parties concerned, and did not pay KRW 55,103,215, in total, 20 workers retired while working in the above company as specified in the attached crime list (1).

B. The Defendant in violation of the Guarantee of Workers' Retirement Benefits Act did not pay KRW 5,378,073 of retirement allowances of retired workers D within 14 days from the date of retirement without an agreement on extension of the payment date between the parties concerned while working for the said company from December 11, 201 to August 11, 2014, as described in the attached Table Nos. 1, 2, 3, 6, 7, 9, 11, 13, 14, 19, 20, and 48,232,153 of retirement allowances of 12 workers retired while working for the said company as described in the attached Table No. 1, 2, 378,073, without any agreement on extension of the payment date between the parties concerned.

C. The Defendant in violation of the Labor Standards Act did not pay KRW 627,351 as wages of September 10, 2014 to retired workers E while working in the said company from September 23, 2014 to September 23, 2014, within 14 days from the date of retirement without an agreement on the extension of the due date between the parties, as shown in the attached Table of Crimes (2). The Defendant did not pay KRW 50,637,351, respectively, within 14 days from the date of retirement without any agreement on the extension of the due date between the parties.
