Defendant

A shall be punished by imprisonment with prison labor for ten months and by imprisonment with prison labor for one year.

No. 1 of the seized evidence shall be from the defendant A.

Punishment of the crime

No one shall, with respect to the use and management of the means of access to electronic financial transactions, borrow or lend the means of access, or keep, deliver or distribute the means of access with the knowledge that they are to be used for a crime or to be used for a crime, unless otherwise provided for in any other Act.

1. At the end of June 2019, Defendant A received a proposal from a name-free person who became aware of the fact that “Kwikset service article” was called “C” at the Internet site “C” and received a proposal that “on the face of delivering another person’s physical card to a designated place, it would give KRW 7-80,000 won per case.” However, Defendant A used the said physical card at the gambling site, and accepted it.

On July 30, 2019, around 15:13, 2019, the Defendant received a copy of the CBB-B-B-B-B-B-B-B-B-B-B-B-B-B-B-B-B-B-B-B-B-B-B-C-B-B-B-B-B-B-B-B-B

Accordingly, the Defendant promised to make compensation as above and kept the means of access knowing that they will be used in the crime.

2. On July 2019, Defendant B received a proposal from a name-free person who became aware of his/her knowledge that he/she would raise job-seeking advertisements at “G” on the Seocho Internet website, to “after collecting a third party’s check, he/she would withdraw money with the third party’s check and transfer money to a specific account, and he/she considered that he/she would use the above check card for the money exchange affairs at the gambling site, but accepted it.

At around 16:43 on July 30, 2019, the Defendant received from A a copy of the KBB Bank Cze Card (Credit Card No. :F) in the name of E on the roads of Manan-gu Ha and the front of the Gyeonggi-si, Mayang-si, Gyeonggi-do, and kept the money in order to withdraw it with the above Cze Card.

Accordingly, the defendant promises the above consideration and commits crimes at the same time.
