Defendant

A shall be punished by a fine for negligence of KRW 3,000,000, and by a fine of KRW 2,000,000.

The above fine is imposed against the Defendants.

Punishment of the crime

1. 피고인들의 피해자 D에 대한 공동상해 피고인들은 2012. 9. 15. 20:00경 천안시 서북구 E 식당에서 식사를 마친 후 카운터 앞에 있는 커피자판기에서 커피가 나오지 않는다는 이유로 위 식당 종업원 F과 말다툼을 하던 중, 그 옆에 있던 다른 손님인 피해자 D(35세)이 피고인 A에게 “좀 조용히 해주세요, 애들도 있는데 너무 하시는 것 아니냐”고 하자, 피고인 A은 이에 격분하여 “넌 뭐야, 새끼야”라고 말하며 피해자의 멱살을 잡고 위 식당 밖으로 피해자를 끌고 나간 다음 주먹으로 피해자의 얼굴을 수회 때리고 다시 피해자를 바닥에 넘어뜨리고 발로 피해자의 몸통 부분을 수회 차는 등 때리고, 그 옆에 있던 피고인 B은 이에 합세하여 발로 넘어져 있는 피해자의 얼굴, 몸통 부분을 수회에 걷어찼다.

Accordingly, the Defendants jointly inflicted injury on the victim, such as salted tensions and tensions of the bones of wood, chrokes, and tensions, which require medical treatment for about two weeks.

2. The Defendants’ joint assault against the victims G were assaulted by the Defendants, on the date and time as described in Paragraph 1, and at the place as described in Paragraph 1, that the Defendants were able to observe the Defendants’ D, stating that “I see why the two people are arbits, that two people are arbits, that they are arbits, that they are arbits, and that there are pregnant women,” and the Defendants A assaulted the Defendants by drinking the victim’s face and arbits, and walking the knee by drinking, and Defendant B assaulted the victim’s knife by drinking.

Accordingly, the Defendants jointly assaulted the Victim G.

3. Defendant A’s injury to Defendant A’s victim H is the same as that described in paragraph (1) at the time and place set forth in paragraph (1).
