1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On April 26, 2016, the Plaintiff entered into a contract with the Defendant to purchase for KRW 320,000,000 (hereinafter “instant apartment”) the building Nos. 112-dong 702 (hereinafter “instant apartment”) owned by the Defendant from February 24, 200, the Plaintiff purchased the building Nos. 112-dong 320,000 (hereinafter “instant sales contract”).
B. On August 2, 2016, water leakage occurred in the living room of the apartment of this case.
E. Around August 5, 2016, G moved out of the apartment of this case. On or around August 5, 2016, the Plaintiff sent to the Defendant through F, which arranged the instant sales contract, the phrase “I would have been ice in the ceiling of 602 on the side of the ward, which would have been able to be able to make a decision by consultation.” On or around August 19, 2016, G cut off and replaced the defective parts of the pipe, and re-entered the cement floor with water leakage from the underwater water pipe down to the ward. However, the damage caused by the said water leakage was spread to the entire house, and the toilet itself has a defect in flooding, and according to the expert’s opinion, it is necessary to replace the entire pipeline.
