1. The Defendant indicated in attached Form 2(a), (b), and (c) on the wall surface of the north-dong of the building listed in attached Table 1.

1. Basic facts

A. On March 1, 2016, the Plaintiff: (a) on March 1, 2016, the Plaintiff is a 60.84 square meters housing of 30.84 square meters (hereinafter “Plaintiff’s housing”).

(2) The Defendant newly constructed a building listed in the attached Table 1 (hereinafter “Defendant building”) around June through July 7, 2016 and completed the registration of ownership transfer in the name of the Plaintiff on May 2, 2016.

B. The current status of the Plaintiff’s housing and the Defendant’s building 1) The Plaintiff’s housing and the Defendant’s building are rhythm with a stone fence as follows. Of the Defendant’s building, the North-dong wall that is toward the Plaintiff’s housing side (hereinafter “Defendant’s wall”).

) Five windows are installed on each of the 1st to 3rd floors. Of the Plaintiff’s housing, the southwest wall covering the Defendant’s building (hereinafter “the wall of the Plaintiff’s building”).

) One window and two windows are installed in the dwelling room. 2) Although the Plaintiff’s housing site and the Defendant’s building site are not set up on the accurate boundary line, the Plaintiff asserts that the above gate is the boundary of the two land. Based on the Korea Land Information Corporation’s restoration survey, the Defendant asserts that the real line installed near the above gate is the boundary of two land. 3) The shortest distance between the Defendant’s wall’s wall is 91 centm from the middle point of the above gate to the above gate, i.e., the lowerest distance between the Defendant’s wall. i.e., the Defendant’s boundary, the lower distance between the Defendant’s wall’s wall’s wall is 113cc. 4m.) and the lower distance between the Defendant’s wall is 13cc. 4m.
