피고인은 2016. 5. 14. 04:50 경 창원시 마산 합포구 B에 있는 C 카페 앞길에서 지인인 D 와 다투던 중 112 신고를 받고 출동한 마산 중부 경찰서 E 파출소 소속 경찰관 F로부터 제지 당하자 발로 피해자의 얼굴 부위를 2회 걷어찼다.
