Punishment of the crime

1. On September 2, 2016, the Defendant who violated the Emergency Medical Service Act does not have a doctor E, nurse F, etc. belonging to the above hospital on the ground that he/she refuses to be hospitalized in the D Emergency Hospital C located in the Busan Metropolitan City, Young-gu, Busan Metropolitan City.

For about 10 minutes, such as taking a bath, the act of emergency medical service workers was obstructed by force by avoiding disturbance.

The Defendant interfered with the performance of official duties at the above time and place, as seen above, assaulted the police officer who was demanded to return home from H of the police officer belonging to the Busan Youngdo Police Station G police box, who was dispatched to the scene after receiving a report on the disturbance 112, and went home from such police officer, and obstructed the performance of duties concerning the maintenance of order and crime control of the above police officer.

The first sentence of Article 37, Article 38(1)2, and Article 50 of the Act on the Aggravated Punishment of Concurrent Crimes committed by a person who was sentenced to a fine in the year 2015 has served as the first sentence for the same type of crime for the sentencing of Article 37, Article 38(1)2, and Article 50 of the Act on the Aggravated Punishment of Concurrent Crimes. Since there has been a history of criminal punishment for several times including suspended sentence due to various crimes related to violence, it is highly likely that recidivism has been committed (the record of being sentenced three times or more, and the record of being sentenced to criminal punishment for various crimes has reached 20 times). At night, the crime of causing disturbance in an emergency room of a hospital is difficult to give prompt treatment to the emergency patients, and thus, it is necessary to strictly punish the patients, their family members, and medical professionals who should look at it, and it is extremely inconvenience and inconvenience for them.
