Defendant shall be punished by a fine of KRW 5,000,000.

If the defendant fails to pay the above fine, 100,000 won.

Punishment of the crime

The defendant is the owner of land B in Busan, which is a development restriction zone.

1. No one shall construct a building, install a structure, change the form and quality of land, cut bamboo and trees within a development restriction zone without obtaining permission from the competent authority or in violation of any terms and conditions of permission, such as construction of a building, installation of a structure, change of land form and quality, cut bamboo and trees;

Nevertheless, the Defendant, without obtaining permission from the head of a Gun having jurisdiction over a plane, cut down trees in a size of approximately 1,00 square meters on the above land on around 2018, and created a site by cutting the above 1,000 square meters on a horizontal basis, thereby changing the form and quality of the land. On the contrary, the Defendant constructed a building for warehouse with a 72 square meters of a floor area, a residential building that became a panel of approximately 30 square meters of a floor area, a residential and warehouse building with a 72 square meters of a floor area, a residential and warehouse building with a string pipe of a size of 28.5 square meters of a floor area, and installed a structure, such as a stone shed of a size of 26.5 square meters of a floor area, and a resting facility with a 10 square meters of a floor area as a tree.

As a result, the defendant did not obtain permission from the competent authorities, and constructed buildings, installed structures, changed the form and quality of land, cut down bamboo and trees within development restriction zones.

2. Where the head of a Si/Gun/Gu fails to comply with a corrective order, without obtaining permission, changes in the use of a building, installation of a structure, change in the form and quality of land, felling bamboo and trees, etc., he/she may issue a corrective order to the relevant violator, and the person in receipt

Nevertheless, the Defendant received a corrective order from the head of the plane captain around January 8, 2019 to voluntarily correct the violation of paragraph (1) by February 8, 2019, but did not comply with it by the above deadline without justifiable grounds.
