A defendant shall be punished by imprisonment for six months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant, from June 200 to June 200, was a person who operated a general restaurant with the trade name “E” in Gwangju City D, and from November 201 to October 2014, leased the said restaurant to another person, and was operating the said restaurant in person from May 2015 to May 2015.
1. Any person who intends to build a parking lot or alter the purpose of use of a building, install a structure, change the form and quality of land, cut bamboo and trees, divide land, stockpile articles, etc. or any person who intends to divert farmland shall obtain permission from the competent authority;
Nevertheless, on November 2014, the Defendant, without obtaining permission from the competent authority, set up a parking lot of 180 square meters in size within a development-restricted zone and a farmland in Gwangju-si, a farmland-based development-restricted zone, which is a farmland, and changed the form and quality of land and diverted farmland.
2. Any person who intends to construct a building, change the purpose of use of a structure, install a structure, change the form and quality of land, cut bamboo and trees, divide land, stockpile articles, etc. or who intends to divert farmland in a development restriction zone shall obtain permission from the competent authority;
Nevertheless, on May 2015, the Defendant, without obtaining permission from the competent authority, installed a camping site of size of 4,658 square meters in G, Gwangju-si, which is a development-restricted area and farmland, and a toilet of size of 16.5 square meters in size, and a toilet of size of 100 square meters in size, and changed the form and quality of land in the development-restricted area by arbitrarily installing three Mongolian-type of size of 75 square meters in the area of one river, and diverted farmland.
3.
