1. Basic facts

A. The plaintiff is the child of the family heir L (the death of December 20, 1998) of the deceased K (the death of August 7, 1948) and the defendant E is the wife of the defendant B.

B. As to the registration (1) in the name of 47 persons M, K, and other 47 in the name of Ma on March 8, 1934, the registration of ownership transfer was completed with respect to the shares of 2142 square meters in the name of 2142 square meters (hereinafter “F land”) in the name of Ma, K, and other 44-7 in the name of 44 persons of Ma, etc. of the above court, (4676, the receipt on March 8, 1934 and the transfer registration was completed on February 3, 1934, with respect to the shares of 47 square meters in the name of Ma and other 44-7 square meters (hereinafter “F land”). Of which, the registration was completed on March 29, 1934 with respect to shares under the name of 6348 on March 29, 193, part of the shares received on March 26, 1967.

(B) Defendant B completed the entire co-owner’s share transfer registration on September 5, 1980 based on sale under the Act on Special Measures for the Transfer of Real Estate Ownership (Act No. 4502, Nov. 30, 1992; hereinafter “Special Measures Act”) with respect to land F by the foregoing court No. 10962, Mar. 9, 194.

(2) The registration of initial ownership of 47 persons, including M, K, etc., was completed on March 8, 1934 with respect to the portion of 44 shares in the name of 44 persons, including M, etc., in the above court as to the portion of 47 shares in the name of 44 persons, which was received on March 8, 1934, No. 4677, which was received on February 3, 1934, and the registration of initial ownership transfer was completed on February 3, 1934 with respect to the portion of 1/47 shares in N on March 29, 1934, which was received on March 29, 1934 by the above court No. 6348, Mar. 29, 1934, which was received on February 3, 1962.
