Reasons
Punishment of the crime
1. Defendant A and B’s joint criminal acts of “2014 High-Ma1335”, despite the fact that the Defendants did not have a bags, did not intend or have the intent to send bags to the victims even if they received the prices of the goods, the Defendants conspired to receive the prices of the goods by inserting a false advertisement as if they were in the Internet goods transaction site. Defendant A, around October 15, 2013, posted a notice to sell the price of the goods by accessing the Internet goods transaction site “the next Dkbook”, which is the Internet goods transaction site in Gwanak-gu, Seoul Special Metropolitan City, by using smartphone at the home of Defendant B, which is located in the Internet goods transaction site, and Defendant B would deliver the price of the goods to the victim E who made a report on the above writing, by delivering the price of the goods in the name of 6 million won from the victim to 300,000 won in the name of 60,000 won in the name of 15,000 won in the name of the victim.
Accordingly, the defendants conspired to acquire the victims' property by fraud.
2. Defendant A’s crime;
A. On February 28, 2014, at around 20:40, the Defendant: (a) sent the victim H a false statement stating that “If paid KRW 20,00,000,00 to the victim, he/she will send the DVD.” However, the Defendant had no intent or ability to sell the DVD. However, the Defendant by deceiving the victim and immediately transferred KRW 20,000,00 from the victim under the name of the price of the goods. (ii) On March 8, 2014, the Defendant sent the victim I a false statement to the Internet NVVER’s Republic of Korea on the Internet NVVER’s Liber, with the communication of KRW 10,00,000,000 to the victim I who made up a statement that “The purchase of the DVE ” on the Internet NVV, and sent the victim I a false statement to deposit the 100,000,00,000 won.
