A defendant shall be punished by imprisonment for one year.
All of the prosecutions against each of the charges of this case are dismissed.
Reasons
Punishment of the crime
[criminal history] On March 17, 2008, the Defendant was sentenced to a summary order of a fine of seven million won due to a violation of road traffic law (driving), etc. at the Seo-gu District Court Branch of the Daegu District Court, on August 4, 2011, the Defendant was sentenced to a summary order of a fine of three million won due to a violation of road traffic law (driving), and on September 3, 2015, on September 11, 2015, the said judgment became final and conclusive on September 11, 2015, upon being sentenced to a suspended sentence of two years due to a violation of road traffic law (driving) at the Seo-gu District Court Branch of the Daegu District Court.
[Criminal facts] The Defendant was living together with the victim C from March 2016 to November 2016.
1. 특수 폭행 피고인은 2016. 7. 29. 11:30 경 대구 달서구 D 건물 202호에 있는 피고인의 주거지에서 피해자와 말다툼을 하던 중 피해 자로부터 헤어지자는 말을 듣자 화가 나 피해자에게 ‘ 씨 발년, 좆같은 년’ 이라고 욕설을 하면서 피해자의 목을 조르고, 피해자에게 ‘ 우리는 절대 헤어질 수 없다, 어디를 가든지 찾아낸다, 끝까지 찾아가서 너도 죽고 나도 죽는다’ 고 말하며 주방에 있던 위험한 물건인 철제 포크를 들고 피해자를 향해 찌르는 듯한 시늉을 하였다.
In this respect, the defendant carried dangerous objects and assaulted the victim.
2. In the Defendant’s residence on August 18, 2016, around 01:00, at around 01:0, the Defendant: (a) reported the victim’s writing to the victim’s E by other male; and (b) took part in the victim’s body while disputing the victim, the victim was going to the body of the victim who attempted to go out of the house and took part in the victim’s body; and (c) “the victim died and died of the escape; and (d) the victim’s family is all dead; and (e) the victim’s market price, which is the victim’s own, took one galth block 2 mobilephone, which is equivalent to one million won.
Afterward, the Defendant stated that the victim of the defect that the victim intends to continue to go out of the house “I find where I want to flee, I find out where I would escape, and die after I find.”
