The judgment of the court below is reversed.

Defendant shall be punished by a fine of KRW 3,000,000.

The above fine shall not be paid by the defendant.

1. According to the summary of the grounds for appeal (in fact-finding), the court below erred by misapprehending the facts and adversely affecting the conclusion of the judgment, although the defendant could sufficiently recognize the fact that he suffered injury to the victim due to the negligence of the victim's fault on the right chest, while treating the victim for injection.

2. Determination

A. In the facts charged, the Defendant is a sexual surgery and doctor who had operated a hospital on the second floor of the Kucheon-gu Seoul Special Metropolitan City B building with the trade name of “Cisung Foreign Department”.

Around April 27, 2010, the Defendant: (a) filed a claim against the victim D (here, 1981 birth) for her fluench surgery; (b) performed pharmacologic treatment and inhaled removal surgery on both chests from May 10, 2010 to February 15, 2012; and (c) performed her fluoral treatment and therapy on both breasts; (b) performed her fluoral treatment by taking appropriate care of the location of the fluoral when treating the fluoral incuous substance by taking care of the fluoral substance; (c) neglected to take care of the fluoral substance in the course of administering the fluoral treatment by taking care of the fluoral substance; and (d) caused the fluoral substance inserted into the chest of the victim

Ultimately, around August 2016, the Defendant suffered from the above occupational negligence that caused the victim to suffer unexpected injury on the number of days of treatment that changes to the right, due to the melting of a relic in a square system, the lower court’s melted the melting body to the right side, and the melting body changed.

B.
