Punishment of the crime

Nevertheless, the Defendant received KRW 1,300,000 from the victim to the AEF account under the name of the Defendant for the consideration of the goods. From around that time to April 6, 2019, the Defendant received totaling KRW 9,971,000 from the victims about 46 times as shown in the attached crime list (1).

Accordingly, the defendant deceivings victims to take the property by deceiving them.

[2019 Highest 1872] On December 28, 2018, the Defendant posted a notice to the Internet AB AC car page to sell beer North Korea, and then sent goods to the victim who reported and contacted the letter to the victim L. (hereinafter “C.”) with a gift certificate number equivalent to KRW 900,000 for beer North Korea’s price.

However, the Defendant did not possess beer North Korea at the time, so even if he received gift certificates from the victim, he did not have the intention or ability to send beer North Korea.

As such, the Defendant, by deceiving the victim, received gift certificates in an amount equivalent to KRW 900,00 from the victim and obtained pecuniary benefits equivalent to the same amount. From that time to April 23, 2019, the Defendant deceivings the victims over 36 times, such as the list of crimes (2) in the same manner, and deceiving them from the victims.
