A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for a period of three years from the date this judgment becomes final and conclusive.

Punishment of the crime

One-person C is the overall responsibility for the operation of unregistered loan companies, and the defendant works as the organization of loan companies in accordance with the direction of the above C, and the loan applicants are in charge of entering into a loan agreement and collecting claims.

1. A person who intends to engage in loan business shall register the loan business with the competent authority having jurisdiction over the relevant place of business by each place of business, and shall not enter into an agreement that exceeds 25 percent per annum if an unregistered credit service provider grants a loan;

Nevertheless, in collusion with the above C, the Defendant lent 3.5 million won after deducting 150,000 won as the prior interest from February 13, 2017 to the loan applicant F in Busan-gu D and E coffee shop, the Defendant agreed to the interest rate of 2,235% per annum exceeding 25% per annum since the court was paid 7.0 million won after the date when the loan applicant F was paid 1.5 million won, and from October 4, 2016 to May 29, 2017, the Defendant used the loan business without registration over a total of 176 times as shown in the attached Table 1 of the daily crimes committed from October 4, 2016 to May 29, 2017.

2. A person collecting claims shall be prohibited from threatening the debtor or using force during the course of collecting claims.

Nevertheless, in collusion with the above C on May 6, 2017, the Defendant, in collusion with the victim G, who was in arrears with the payment of the debt at the remote site, was fright to contact other families by a mobile phone text message;
